Retroactive and prospective application of the change of precedent in the Colombian Council of State. Analysis and proposed solution.
Abstract
This article reflects on the application over time of the change of precedent in the Colombian Council of State and how problematic is the application of the retroactive (or retrospective) effect for the guarantee of the principles of legal certainty and legitimate confidence. For this purpose, we analyze some cases decided by this judicial body, in which we can observe the modulation of temporary effects and, finally, we present an academic proposal with the aim of offering a solution that harmonizes retroactivity and the safeguarding of the principles.
