El acuerdo de la OMC sobre subvenciones a la pesca: ¿un gran avance o una botella perdida en el mar?
Resumen
El Acuerdo de la OMC sobre Subvenciones Pesqueras (AFS), adoptado en la 12ª Conferencia Ministerial de 2022, supone un paso importante hacia la protección de los océanos, ya que pretende regular las subvenciones perjudiciales que agotan las poblaciones de peces. Aunque representa un avance en el uso de la legislación comercial para alcanzar objetivos medioambientales, se queda corto a la hora de garantizar una gestión sostenible de los recursos marinos. Este ensayo compara en primer lugar el AFS con la CNUDM y el ANUPP para evaluar la alineación jurídica y los principios compartidos; a continuación, evalúa el AFS a través de la lente de los Enfoques del Derecho Internacional del Tercer Mundo (TWAIL, por sus siglas en inglés), y concluye con los últimos avances de la 13ª Conferencia Ministerial.
